Social Security Act, 2008

An Act to provide Universal Social Security benefits.

Be it enacted by Parliament of the Republic of India as follows:

S.1.Definitions

1. Persons are said to have made regular contributions if they have made contributions or have been credited for them for at least 54 of the last 60 months and have no net arrears.

2. Family shall be defined as spouse and children below the age of 21.


S.2.Employee Provident Fund

1. The Employees' Provident Fund Organisation, India shall be responsible for administration of the programme.

2. Benefits may be dispatched through Post Offices under the Indian Postal Service.

S.3.Contributions

1. Any citizen of India, or legal resident may apply for a Permanent Account Number at their nearest post office. The Social Security Office shall issue a Smart Card and a Permanent Account Number.

2. Establishments employing more than 5 persons are required by law to ensure that their employees are in possession of Permanent Account Numbers, and shall be responsible for deducting Social Security Contributions from their paycheques.

3. Contributions shall be set as follows:
a. A Social Security Fee shall be payable by all persons with income greater than the Poverty Line.
b. The Finance Minister may establish a minimum threshold and levy a cess as a proportion of income earned above the threshold.

4. The following persons shall be exempt from making contributions and shall be credited for them nonetheless.
a. Persons in full time education.
b. Persons below poverty line certified as such through possession of a Below Poverty Line Card.
c. Persons in receipt of benefits.


S.4.Contributions Linked Benefits

1. Unemployment Benefit shall be provided for temporary loss of occupation in the following circumstances:
a. They must be registered with the National Employment Agency and actively seeking work.

2. Sickness benefit shall be provided during any period of hospitalisation of self or family.

3. Disability benefit shall be provided in case of disability preventing the worker from carrying out gainful employment.

4. Health Insurance coverage upto a maximum amount for self and family shall be provided.

5. Maternity benefit for 12 weeks for the birth of each child upto a maximum of two children.

6. Bereavment benefit shall be paid upon the death of the contributor to the immediate family.

7. Persons in employment whose families are below poverty line may claim Income Support.

8. Pensions shall be paid to persons above the age of 65. A surviving spouse shall be allowed to collect pensions upon the death of the contributor.

9. Separation Benefit shall be paid to spouses of contributors under the age of 65 who were legally married to a contributor for more than 5 years.

S.5. Enactment

This Act shall come into effect upon receiving presidential assent.

Schedule

1. The Benefits provided under this act will replace the Below Poverty Line Family Benefits, with the exception of the National Rural Employment Guarantee.
